Language Guidance for Other Countries

If you wish to bequest to kitson library from a country other than the united states, the following guidance and language may help.

Costa Rica

To add a clause in a will or trust (English below):
Para agregar una cláusula en un testamento o fideicomiso:

Español

“Que es su voluntad expresa heredar y constituir un legado por la suma de ($ or CRC)_______________ en favor de la Fundacion David Kitson entidad poseedora de la cédula jurídica 3006220190, en beneficio de la Biblioteca David Kitson y sus objetivos generales . De manera que solicito expresamente que dicha suma sea depositada en la cuenta bancaria de la Fundación legataria número ______ del banco_________”. Favor de ponerse en contacto con nosotros para los datos del banco.

Le recomendamos que confirme estas instrucciones con su asesor legal o financiero.

“If at my death the charity named as a beneficiary in this my Will or any Codicil hereto has changed its name or amalgamated with or transferred its assets to another charity then my Executors shall give effect to any gift made to such charity as if it had been made (in the first instance) to the charity in its changed name or (in the second instance) to the charity which results from such amalgamation or to which such transfer of assets has been made."

Canada

“I give, devise, and bequeath to the David Kitson Library Foundation Biblioteca David Kitson in Spanish, with legal identification number 3006220190, a non-profit organization located in Nosara, Costa Rica, with legal address of 25 meters east of the EBAIS building, Bocas de Nosara the sum of CAD_______________ for the benefit of David Kitson Library and its general purposes.”

“If at my death the charity named as a beneficiary in this my Will or any Codicil hereto has changed its name or amalgamated with or transferred its assets to another charity then my Executors shall give effect to any gift made to such charity as if it had been made (in the first instance) to the charity in its changed name or (in the second instance) to the charity which results from such amalgamation or to which such transfer of assets has been made."

UK

'I give free of tax the sum of £xxxx.xx (words) to Fundación Biblioteca Kitson, with legal identification number and legal address of 25 meters east of the EBAIS building, Bocas de Nosara, Nosara, Costa Rica, for the general purposes of Fundación Biblioteca Kitson, and I declare that the receipt of their Treasurer or other proper director or officer for the time being shall be a full and sufficient discharge.’

Germany

As explained to us, in Germany, wills and bequests must be written by hand and signed by an individual or, for married people, by both partners. The will must be filed at the appropriate Nachlassgericht (Probate Court). The instructions, in German of course, could be:

“I give, devise, and bequeath to the David Kitson Library Foundation, Biblioteca David Kitson in Spanish, with Identification Number 3006220190, a non-profit organization located in Nosara, Costa Rica, at the address, 25 meters east of the EBAIS building, Bocas de Nosara, the sum of EUR_______________ for the benefit of David Kitson Library and its general purposes.”

“If at my death the charity named as a beneficiary in this my Will or any Codicil hereto has changed its name or amalgamated with or transferred its assets to another charity then my Executors shall give effect to any gift made to such charity as if it had been made (in the first instance) to the charity in its changed name or (in the second instance) to the charity which results from such amalgamation or to which such transfer of assets has been made.”
